Covid 19 Waiver

Player Covid-19 Wavier, Consent, Release of Liability

 

Coaches and Parents, please take the time to read this message entirely.  It is vital that you have all this information.  Levittown Seaford Wantagh Athletic Association (hereinafter LSW), pursuant to the laws of the State of NY and the Executive Order of Gov. Andrew Cuomo authorizing youth sports, including baseball to commence on July 6, 2020  to begin practicing, training and playing baseball again with the below precautions in place. 

The novel corona-virus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.  COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. LSW has put in place preventative measures to reduce the spread of COVID-19; however, LSW cannot guarantee that you or your child(ren) will not become infected with COVID-19.  Further, attending LSW practices, games, camps or events could increase your risk and your child(ren)’s risk of contracting COVID-19.

 

In light of the existing COVID-19 Public Health Emergency in New York State (“State”) LSW will implement and enforce State mandated social distancing requirements as well as comply with all other State and local guidelines applicable to the safe conduct of sports play during the COVID-19 Health Emergency. 

 

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending LSW practices, games, camps or events and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at LSW practices, games, camps or events may result from the actions, omissions, or negligence of myself and others, including, but not limited to, LSW employees, coaches, volunteers, and program participants and their families.  

 

Further, I attest that my child(ren) are healthy now and will be monitored by me, a parent, or a guardian before attending all LSW practices, games, camps or events each day and I will hold my child out if any such symptoms arise.  A health motorization or check ensures and confirms that your child(ren) has not had these symptoms for 48 hour prior to each LSW practices, games, camps or events; fever, abnormal cough of any kind, shortness of breath, body aches, sore throat, or loss of taste and smell. I attest that my child(ren) has not knowingly been in close contact with anyone who is known to have or be symptomatic of the Covid-19 virus and has not traveled outside the US or to any of the present restricted travel states including Alabama, Arkansas, Arizona, Florida, North Carolina, South Carolina, Texas and Utah, been in contact with anyone who has traveled outside the US or with anyone who has travelled to the aforementioned states in the last 14 days

 

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at any LSW practices, games, camps or events that LSW or participation LSW programming (“Claims”).

 

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Levittown Seaford Wantagh Athletic Association (LSW), its employees, agents, and representatives, coaches, assistant coaches and volunteers of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LSW its volunteers, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LSW program.

 

I further expressly agrees that the foregoing ASSUMPTION OF RISK, RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.

PARENT CODE OF CONDUCT

PURPOSE:   The LEVITTOWN SEAFORD WANTAGH ATHLETIC ASSOCIATION strives to create and offer quality learning and athletic opportunities. The following CODE OF CONDUCT AGREEMENT (3/18) is constructed as an instrument to govern and emphasize those values, principles, and beliefs which are central to the foundation, structure, and operation of the LEVITTOWN SEAFORD WANTAGH ATHLETIC ASSOCIATION (LSWAA).  At all times, we agree to and support and promote:

  • Positive and exemplary sportsmanship and appropriate demeanor by everyone.
  • Safety and well being of players, coaches, umpires, and spectators.
  • First-class representation of players, parents/families, coaches, umpires, and spectators.
  • Respect and pride for the presentation of our flag, pledge of allegiance, and national anthem (...and those of other countries).
  • Always playing within the established rules of the game (e.g., age limits, etc.).

The understanding that participation in the LEVITTOWN SEAFORD WANTAGH ATHLETIC ASSOCIATION is a privilege and a player/family decision, completely voluntary, without any pressure or coercion and dual/multiple participation questions or consequences (with other teams, leagues, all-star post-season play, and/or organizations) are 100% family matters and family responsibilities. 

Therefore, I pledge to honor and support the team and LEVITTOWN SEAFORD WANTAGH ATHLETIC ASSOCIATION by adhering to the LSWAA’s Player Code of Conduct as stated below:

  • I will remember that the game is for the players and not for the adults.
  • I will be positive and supportive of each child’s efforts, recognizing that each child is an individual and each possesses different skills and abilities. 
  • I will remember that the development of baseball skills through practice and perseverance is more important than winning games.
  • I will encourage good sportsmanship by demonstrating positive support and behavior toward all players, coaches, officials and other parents/spectators at every game or practice.
  • I will come to the events drug and alcohol free and maintain that environment throughout the event.
  • I will treat coaches, umpires and league officials with courtesy and respect before, during and after games.
  • I will not undermine or question the coach’s instructions, directions or decisions. 
  • I will place the realistic skill development of my child above my own personal expectations.
  • I will stay out of the dugout before, during or after games and practices. If I would like to speak to a coach, I will respect the 24 hour rule and will not contact the coach until after 24 hours have passed. If the matter is one of safety or integrity, I will speak directly to a board member.
  • I agree that I will support the emotional and physical well-being of all the participants on my child’s team, ahead of any personal desire to win games or any desire for personal glory.
  • I will follow the LSWAA policy on social media.

SOCIAL MEDIA POLICY:  This policy shall apply to all coaches, players, parents, guardians or other persons associated with LSWAA regarding use of social media.  This policy applies to the above participants on and off of the field. The goal of LSWAA is to ensure that its participants – coaches, players, parents, guardians, fans, etc. – maintain the highest standard of sportsmanship and ethical behavior at all times.  Adherence to this policy shall be a condition for continued participation in the LSWAA program.   A parent/guardian is required to acknowledge this policy in writing and inform the participating player of the policy. 

  • Social media can be fun, helpful and dangerous.  Negative comments and images, bullying, and criticism can be dangerous and harmful to  people’s reputation and the image of the sport and LSWAA.  
  • Do not use social media to be critical of teammates, coaches, umpires, board members, volunteers, officials, administrators, volunteers  or spectators.
  • Use social media as a positive outlet to promote players, teammates, teams, clubs and others involved in baseball.
  • When using social media, show the same respect and regard for people that you would show and are expected to            show when playing, officiating or attending a game.
  • When in doubt leave it out.
  • Do not tolerate or condone poor social media behavior or actions. Please report any violations of this policy to a Board Member immediately.
  • If you are found to have acted improperly on social media regarding a baseball related matter, or something that reflects poorly on LSWAA, you and/or your child/participant may be suspended or asked to leave LSWAA. 

Failure to comply with any suspected violation of the above Code of Conduct should be reported to the LSWAA Board.  Violations may result in game suspension or banishment from the league.  

Board meetings are open to all members.  If you have an issue, please contact a board member, and we will add you to the agenda to discuss.  As an organization, we value being transparent and welcoming.

The clear understanding that all medical, financial, and legal liability issues, activities, and consequences are the exclusive responsibility and domain of the player and/or his respective family, parent(s), and/or guardian(s)... at no time will the LEVITTOWN SEAFORD WANTAGH ATHLETIC ASSOCIATION nor any of its associated personnel (founder, manager, coaches, board of directors, et al.) be sued legally (individually, collectively, or organizationally) in any manner, for any expenses, damages (perceived or real, intentional or unintentional), losses, injuries, complaints/problems, complications, and/or inconveniences which may result from participation with the associations activities and/or initiatives. We agree to release and forever hold harmless said association and related personnel in all matters, legal, medical, personal, financial, and/or otherwise.  No claims shall be made for any reason.

We have read, have discussed, and understand this CODE OF CONDUCT AGREEMENT, and fully, unequivocally support it, its intent, and its essence, and that violation of this agreement will result in the suspension and/or termination of my membership as detailed in the Association’s By-LawsPlayer.

MY CHILD________________________________ IS IN GOOD HEALTH AND HAS MY PERMISSION TO PARTICIPATE IN THE LSW/FLAG FOOTBALL.    OUR FAMILY HEALTH INSURANCE IS THE PRIMARY INSURANCE.  IN THE EVENT OF AN INJURY, COVERAGE FROM LSWAA IS TO BE CONSIDERED SECONDARY COVERAGE.  ADDITIONALLY, NYS LAW REQUIRES THAT PARENTAL PERMISSION BE OBTAINED SO THAT ANY UNFORESEEN MEDICAL ATTENTION MAY BE ADMINISTERED WITHOUT DELAY.

CODE OF CONDUCT

 

I, (PARENT/GUARDIAN) ________________________________, UNDERSTAND THAT IN THE EVENT THAT MY CHILD OR GUARDIAN IS DISRUPTIVE, I WILL BE CONTACTED/ASKED TO REMOVE MY CHILD OR SELF FROM THE FLAG FOOTBALL FIELD.  IN THE EVENT THAT MY CHILD OR SELF CONTINUES WITH DISRUPTIVE BEHAVIOR, I UNDERSTAND THAT HE/SHE/GUARDIAN WILL NOT BE ABLE TO RETURN TO THE LEAGUE. 

 

I ALSO UNDERSTAND THAT MY CHILD IS ENROLLED IN A FLAG FOOTBALL LEAGUE AND DROP OFFS ARE NOT ALLOWED.

 

I UNDERSTAND THAT LSW WILL NOT REFUND MY MONEY ONCE MY CHILD IS ENROLLED.  I ALSO UNDERSTAND THAT LSW IS NOT RESPONSIBLE FOR ADVERSE WEATHER CONDITIONS.
